Terms and Conditions

WOW HD is owned and operated by Élan Media Partners Pty Ltd. We invite you to print out our Terms and Conditions, or we can email these to you on request. Changes to our Terms and Conditions and Frequently Asked Questions are made from time to time, and your continued use of our website following any change shall be deemed as your acceptance of such change. It is the user’s responsibility to regularly check our Terms and Conditions for changes. A copy of our Terms and Conditions can be requested via Customer Service Centre.

We reserve the right to alter prices to take into account forces beyond our control (e.g. currency fluctuations).We are unable to supply minors (under the age of 18).

We will not be liable for any loss or damage caused by us, our employees or our agents in circumstances where:

  • there is no breach of duty of care owed to you by us or by any of our employees or agents;
  • such loss or damage is not a reasonably foreseeable result of any such breach;
  • any increase in loss or damage results from breach by you of any of these terms and conditions; or
  • such loss or damage relates to any business or non-consumer loss or damage including, without limitation lost data, lost profits and business interruptions.

We accept no liability (to the fullest extent allowed by law) for the accuracy of information contained on album detail pages or on the website, which may contain technical inaccuracies or typographical errors.

We reserve the right to refuse to supply any person or company for any reason. Any abusive language directed at our Customer Service Representatives will not be tolerated and may result in the cancellation of your membership with WOW HD

If any part of these Terms and Conditions are declared void for unfairness pursuant to the Unfair Terms in Consumer Contract Regulations 1999, the remaining contract shall only continue to bind the parties if it is capable of continuing in existence without the unfair terms.

These Terms and Conditions contain the whole of our agreement relating to your purchase, together with our website prices and contact details. To protect your own interests please read our terms and conditions carefully before accepting them. If you are uncertain as to your rights or want any explanation about our terms and conditions please write to our customer service centre at the address provided.

If an error is discovered in the price of the item(s) you have ordered, we will inform you and issue a full refund as soon as possible. We shall be under no obligation to fulfil an order for an item which was advertised at an incorrect price, if the item(s) has been charged and not despatched we will cancel and refund your order.

You shall not obtain any right of copyright (or similar rights) in your purchase, of which any unauthorised use including copying, letting for hire or sale is strictly prohibited.

All designs, graphics and other artwork (including the selection and arrangement of text and graphics) is and remains the copyright of Élan Media Partners Pty Ltd., although permission is granted to you to electronically copy and hard-copy print portions of our website for the sole purpose of placing an order, reading the terms and conditions with more ease or using this website for your shopping. Any other use is strictly prohibited.

Élan Media Partners Pty Ltd. is the exclusive owner of the WOW HD trademark and designs and get-up and all other company names and logos are the property of their owners. No permission is given in respect of the use of any brand names, product names, trademarks or their respective owners, and such use may constitute infringement of their owner's rights. WOW HD reserve the right to cancel (and refund any part cash paid) any transaction which may contain a voucher/promotional code.

Some customer orders will be subject to a security check prior to dispatch. Any communication regarding this check will be emailed from verification@wowhd.com and refer directly to your WOW HD order number. Please refer to our FAQ ‘Shopping Help’ for more information about our security process.

When accepting our Terms and Conditions you are also accepting our Cookies Policy and Frequently Asked Questions selection.

Virgin Experience

As Élan Media Partners are acting as an agent for a third party supplier. Élan Media Partners does not assume any responsibility or liability for the actions, product, and content of any other third parties.

Experience descriptions, formats and durations

The information provided on our site by Acorne Plc with regards to the experience descriptions, formats and timing given on the WOW HD websites are only intended to present a general idea of the experience and shall not be considered binding. In particular, photographs are for illustrative purposes only and do not form part of any contract between you and WOW HD. As WOW HD offers experiences by a third party supplier at a wide number of venues, details such as session lengths, itineraries, equipment used and numbers of participants may vary from location to location. Most experiences will be “open” days meaning that other members of the public will be taking part too. This could mean taking your turn with other members of the public. If delays, curtailments and breakdowns are not within WOW HD’s control, we cannot be held liable if these should occur.. lease note that we reserve the right to alter any part of the experience where such an alteration has been imposed by the operator. We cannot be held responsible for descriptions by or on any third party or agent sites.

Experience suppliers will have third party liability insurance it is your responsibility to ensure you are adequately covered.

Please note that affiliate links or promotions running on WOW HD Will not be applicable to Virgin Experience products.

Availability

The recipient is free to book their preferred date within the Voucher validity period. Experiences are subject to availability and, in some cases, may be subject to weather conditions (if your experience is weather dependent we advise telephoning the centre before you set out to confirm that the event will take place). To avoid disappointment it is recommend that customers book well in advance, at least 6-8 weeks for the majority of experiences. During peak periods it may be necessary to allow a longer notice period although some operators may occasionally be able to fit in a booking at short notice. We recommend booking as early as possible as you must have undertaken your experience before the expiry date printed on the front of your Voucher. We strongly advise that you do not make any travel, accommodation or other arrangements until you have received confirmation of your booking from the experience operator. Once a date has been booked with a supplier your Voucher will be deemed to be used at that point.

Restrictions

Most experiences are subject to restrictions. These could include (but are not limited to) age, height, weight, physical and medical restrictions, and may vary from centre to centre so please check before making your booking. Details of these restrictions are available on our website and contained in your pack. It is your responsibility to ensure that you choose an experience appropriate for the intended recipient and it is the responsibility of the recipient to double check that the restrictions are not prohibitive. If you are unsure of the suitability please contact our customer service team.

Prices & locations

Virgin Experience Day reserve the right to vary the prices of the experiences which they offer. A Virgin Experience Day current experience prices may differ from the value of your face value voucher. Locations are correct at the time of going to press but may change or be withdrawn for reasons beyond our control. For overseas experiences prices may fluctuate with exchange rates.

V.A.T.

Prices shown include V.A.T when and where applicable.

Despatch

Acorne Plc and Élan Media Partners cannot be held responsible for any goods damaged in the post or any postal delays.

Security

Vouchers are valuable documents and cannot be replaced if they are lost, damaged or stolen and are invalid if altered or tampered with. Acorne Plc and Élan Media Partners accept no liability in these circumstances.

Validity

The Voucher validity period is generally 9 months from date of purchase unless otherwise stated. Experiences must be booked and undertaken prior to the expiry date printed on the front of the Voucher, otherwise the Voucher will be deemed to be invalid and no liability will be accepted by Acorne Plc and Élan Media Partners.

Extensions

The validity period of most Vouchers may be extended once only at Acorne Plc and Élan Media Partners absolute discretion.

Refunds

A full refund is available, as long as the voucher is returned to us within 7 days of Purchases. A refund can only be issued to the purchaser. A refund cannot be given once a booking has been made. All transactions are in GBP and we are not liable for any fees imposed by your bank or third party organisation as a result of placing an order from overseas.

Experience operators

Acorne Plc has contracted agreements with its operators regarding their standard of performance and, where appropriate, operators are registered with their relevant controlling or regulatory bodies. Once a booking has been made with an experience operator the participant is also bound by the Terms and Conditions of that operator. By purchasing or redeeming an Virgin Experience Day Voucher you acknowledge that experiences are dependent on certain factors beyond the control of Acorne Plc and Élan Media Partners and agree that Acorne Plc and Élan Media Partners is not liable for the cancellation, postponement or alteration of any experience for reasons beyond its reasonable control (including but not limited to weather-related reasons, mechanical failure, location changes or otherwise). If mechanical breakdown should occur you should expect reasonable substitutions without notice. Please note that experiences and other products are subject to change without notice. This does not affect your statutory rights.

Cancellation by experience operators

If an experience is cancelled by the operator either before or on the day of the event due to circumstances beyond their control, the operator will arrange to re-book the participant at a mutually agreed time on our behalf. Acorne Plc and Élan Media Partners cannot be held liable for any costs including (but not limited to) travel expenses or pre-booked accommodation costs incurred by the participant in the event of a cancellation and Acorne Plc and Élan Media Partner’s total liability for any claim in connection with an Virgin Experience Day experience shall be limited to the price paid for the experience.

Cancellation by participants

Once you make a booking with an experience operator you are bound by their terms and conditions. Make sure you understand their rules regarding changing or cancelling a booking (particularly at short notice) as a refund will not be offered in the case of infringement of these rules. Acorne Plc Cancellation Indemnity policy may provide a replacement Voucher in the event of cancellation by the participant owing to circumstances beyond their control.

Personal Accident Insurance

PA Insurance to the value of £50,000 is included at no extra charge with most Vouchers purchased direct from Acorne (travel/holidays, food/drink and other tangible products are excluded).

Liability cover

All UK and Eire experience operators contract with us to indemnify participating Voucher holders against damage to equipment they use, and against liabilities to third parties, subject to limits and compliance with their rules, terms and conditions, which may vary between operators. They also hold cover, subject to terms and limits, for contingent liabilities arising at these operators' venues. Where experiences require overseas travel, the participant is strongly advised to take out additional specialist travel insurance. Some experience operators may offer additional indemnities at an extra cost. Such indemnities are entirely optional and you are under no obligation to purchase them, as your entitlement to undertake the experience will not be affected if you choose not to accept an additional indemnity. Any additional indemnities purchased from an experience operator will be governed by that operator’s terms and conditions and do not form any part of your contract with Acorne Plc and Élan Media Partners.

Third parties and re-sale

A person who is not named on the face of the Voucher or recorded as the purchaser by Acorne Plc and Élan Media Partners has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any terms and conditions of booking. A Voucher which has been re-sold (for example, through internet auction sites or by any other means) without our prior consent will be considered invalid. Neither Virgin Experience Day and Élan Media Partners nor any of its experience operators will be under any obligation to provide any service.

These terms and conditions do not affect your statutory rights as a consumer, and are governed by and in accordance with English law. The purchaser of a Voucher and/or the participant in an experience agrees to the jurisdiction of the English courts. All the clauses and sub clauses in Acorne Plc and Élan Media Partners terms and conditions are independent of each other. If one clause or sub clause is invalid or unenforceable, this will not affect any other clause or sub clause. These terms & conditions are subject to change.

The details listed above are the terms and conditions applied to Acorne Vouchers and experiences. Your statutory rights are not affected.

These Terms and Conditions are governed by the laws in force in Victoria, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Victoria, Australia and any courts, which may hear appeals from those courts.
